*** PRESS RELEASE *** Yonkers Police Detectives arrest, charge 16-year-old in shooting death of 17-year-old
Yonkers, NY – On Tuesday, January 29th,
2019, at approximately 3:09 PM, members of the Yonkers Police Department
responded to the area of South Broadway at Vark Street on reports of shots
fired; at the same time, two victims with apparent gunshot injuries arrived at
Saint Joseph’s Hospital; one of the victims, a 17-year-old male resident of
Yonkers, subsequently died from his injuries. Officers cordoned off the area
and initiated a criminal investigation.
Detectives from the Major Case Squad
and Crime Scene Unit responded to the scene, interviewing subjects and
witnesses, reviewing surveillance video, and processing forensic and ballistic
evidence. Investigation has yielded that two groups of teenagers known to each
other were engaged in a dispute that escalated into a fight and physical violence
in the area of 44 Vark Street. During the fight, a male suspect allegedly displayed
a handgun and fired several shots in the direction of the opposing teenagers,
striking two of them. The 17-year-old victim was struck twice in the back torso
and succumbed to his injuries at Saint Joseph’s Hospital; the second victim, an
18-year-old male resident of Yonkers, was struck twice in his hip and lower
extremities and is currently in stable condition at a local area hospital. The
deceased victim is identified as Kasean TUTHILL, a resident of Gaffney Place in
this City.
Investigators working throughout the
night developed information to identify the perpetrator and establish probable
cause to charge him with the crime of murder; he was apprehended this morning
and is currently being processed at a police facility pending arraignment. He
is identified as Gavin CHISOLM, a 16-year-old resident of Sunnyside Drive in
this City. During the incident, CHISOLM suffered apparent stab wounds to his
thigh area.
CHISOLM is being arraigned as an Adolescent
Offender in the Youth Part of the Westchester County Court; he is being charged
with one count of Murder 2, a Class A-1 Felony, and one count of Attempted
Murder 2, a Class B Violent Felony, in the New York State Penal Law. The case
is being prosecuted by the Westchester County District Attorney’s Office.
Police Commissioner Charles Gardner stated, “Violent acts, even those committed by young
adults, will not be tolerated in our City; gun violence has no place in our communities,
and let this swift arrest be a stark reminder to our young people that their actions
may have life-altering consequences – in this case, two lives and two families have
been left devastated.”
The investigation is
on-going; due to the ages of those involved, no additional information will be
released. The City of Yonkers and Yonkers Police Department offers its
condolences to the family of the victim.
NOTE:
Booking charges are merely accusations and the defendant(s) are presumed
innocent unless and until proven guilty in a court of law. ###
