Bautista-Cruz was charged with DUI following a motor vehicle collision. He was also charged with reckless driving, following too closely, open container in a MV, unlicensed driver and refusing to submit to a breath test. He was also charged with possession of a false Identification card, 2C:21-2.1D. He was processed and released following his arrest.

Driver 1, Michael Rutkowski stated he was traveling north on S. Delsea Drive at approximately 40 mph as he approached Smith St. Rutkowski explained that he observed vehicle 2, (described as a silver sedan) stopped at the stop sign. As Rutkowski continued traveling north bound on S. Delsea Drive, vehicle 2 pulled out into traffic from Smith Street and collided with the passenger side of his vehicle. At the scene, Rutkowski complained of no pain or injuries and refused medical treatment. Vehicle 1, a 1992 GMC Sierra sustained extensive damage to the passenger side door and rear fender. Rutkowski refused to have the vehicle towed from the scene and was able to drive it. Driver 2, Deanita Allender stated she was leaving the Holiday Inn Express west bound on Smith St as she approached S. Delsea Drive. Allender related that she stopped at the Stop sign and traffic appeared to be clear, allowing her the opportunity to pull out into traffic. Allender explained that she did observe vehicle 1 as it approached, however she believed that she had ample time in which to enter traffic. Allender stated that as she pulled into traffic, she struck the passenger side of vehicle 1 which was traveling north on S. Delsea Drive. Allender complained of pain to her left arm, however when Vineland EMS arrived on scene she refused treatment. Vehicle 2 sustained extensive front end damage and was parked on the private property of the Holiday Inn Express. Point of impact was on S. Delsea Drive approximately 10 feet west of the east road edge of S. Delsea Drive and approximately 10 feet south of the north curb edge of Smith St. Driver 2, Deanita Allender was issued a summons # 0614-VC-011450 for Failure to Stop or Yield in violation of NJS 39:4-144. Driver 1, Michael Rutkowski was issued a subpoena for the set court date.

Driver #1 stated she was traveling southbound on N Delsea Dr, approaching the intersection with W Oak Rd. She saw Vehicle #2 stopped in front of her for a red traffic light. As she tried to apply the brakes, the pedal gave resistance and she was forced to let off the brake pedal and reapply the brakes again. She was unable to stop in time and struck Vehicle #2 in the rear bumper.
Driver #2 stated she was stopped for a red traffic light in the southbound lane of N Delsea Dr at the intersection with W Oak. Driver #2 said she felt her car jolt forward when Vehicle #1 rear ended her.
Driver #1, Driver #2, and rear passenger of Vehicle #1 had no complaints of pain at this time and declined any medical evaluation or treatment.
Vehicle #1 sustained minor damage to the front bumper of the vehicle. Vehicle #2 sustained minor damage to the rear bumper. Vehicle #1 and Vehicle #2 were driven from the scene.
Driver #1 was issued a summons 0614-VC-009653 for Careless Driving (39:4-97).
No witnesses were located at the scene.

Driver #1: Benevento, Anthony (M-19) Bellmawr NJ
Driver 1 stated he was west on Mays Landing Road approaching Union Road when his vehicle experiencing mechanical failure. He stated he then lost control of his vehicle crashing into a small curb at 5600 Mays Landing Road and then into several trees on the property. His vehicle rolled over and was resting on it's rooftop when I arrived. Driver 1 was unable to produce a vehicle insurance card at the time of the investigation therefore he was issued summons # 0614-VC-11356 for Failure to Provide Vehicle Insurance, 39:6B-2, and 0614-VC-11355 for Careless Driving, 39:4-97 with a court date before the Vineland Municipal Court. I spoke to a witness, Matthew Bergamo, who stated he was stopped at the stop sign, north bound on Union Road at Mays Landing Road, and saw Vehicle 1 lose control as it was west on Mays Landing Road. He stated he watched as it crashed into several trees on the property of 5600 Mays Landing Road and immediately went to the vehicle finding that Driver 1 was self- extricating himself from the vehicle. He then called 911 to report the crash. I spoke to the property owner of 5600 Mays Landing Roadon 08/16/16 and discussed the crash and damage to her property, several trees.

Driver #1 stated he was driving east on Maple Ave approaching the intersection of Maple Ave and N Lincoln Ave. Driver #1 stated when he got to the intersection, he stopped at the stop sign, and could not see any cars coming due to sun glare. Driver #1 stated he then proceeded forward and collided with Vehicle #2. Driver #2 stated he was traveling north on N Lincoln Ave. As Driver #2 entered the intersection of Maple Ave and N Lincoln Ave, he was struck by Vehicle #1 which ran the stop sign at Maple Ave . Driver #2 stated he could not see the vehicle until it was approximately 3 feet away and he did not have time to react. Driver #2 believed Vehicle #1 was traveling at least 40mph when it struck him. Witness #1 and Witness #2 both stated Vehicle #2 was traveling north on N Lincoln Ave when Vehicle #1 went through the stop sign (without stopping) and struck Vehicle #2. Driver #1 claimed no injury. Driver #2 suffered a cut to his left forearm. Passenger #1 had a complaint of pain to her right shoulder. Vehicle #1 suffered front end damage and was driven from the scene. Vehicle #2 suffered driver side damage, including side air bag deployment and was towed from the scene by Rulyn's Towing. Vehicle #2 was an Enterprise Rental Car which was self-insured. Driver #1 was given the following summonses 0614-V-122509 for 39:4-144 0614-V-122508 for 39:4-97

Driver #1 stated he was traveling east on E. Wheat Rd when he attempted to make a left turn onto N. Main Rd but did not make the turn, went over the curb and hit the traffic signal on the northeast corner of the intersection. He stated that he thinks he had a tire blow out and that is what caused him not to be able to make his turn. Passenger #1 stated confirmed the direction of travel but was not sure what caused the collision. Witness #1 stated she was traveling south on N. Main Rd. when she observed vehicle #1 strike the traffic signal at a high rate of speed. She stated she wasn't sure if the vehicle was coming northbound on N. Main Rd or eastbound on E. Wheat Rd because it happened so fast. There were no reported injuries at the scene. Vehicle #1 was towed from the scene by M&R Auto body because it was not drivable. The Cumberland County Road Dept. was notified about the traffic signal on the northeast corner of N. Main Rd and E. Wheat Rd being struck and down in the roadway. Driver #1 was issued a summons (0614-VC-010338) for careless driving (39:4-97) and a summons (0614-VC-010339) for having a suspended DL (39:3-40).

Driver #1: Esquilin, Destiny (F-18) Vineland
Driver #2: Lair, Patricia (F-28) Newfield
Driver #1 stated she was stopped on Sharp Rd at the intersection of N Valley Ave and Sharp Rd. Driver #1 looked both ways and proceeded through the intersection when she was struck by Vehicle #2. Driver #1 claims that she did not see Vehicle #2 prior to entering the intersection and stated “she came out of nowhere”. After Driver #1 was struck by Vehicle #2, Driver #1’s vehicle went into a utility pole (#VE7351).
Driver #1 sustained cuts to her elbow and legs in the area of the knee, front passenger complained of head pain, rear passenger complained of chest pain. Driver #1 and occupants were transported to Vineland Inspira by Vineland EMS.
Vehicle #1 was towed from the scene by Roc Towing.
Driver #2 stated she was traveling north bound on N Valley Ave and as she went through the intersection at N Valley and Sharp Rd, Vehicle #1 pulled out in front of her. Driver #2 stated she was unable to avoid the collision and after striking Vehicle #1, her vehicle went off the road and struck the support cable for the utility pole (#VE7351).
Driver #2 and occupants did not report any injuries however she requested to have Vineland EMS transport her and the occupants to Vineland Inspira to be evaluated for precautionary measures.
Vehicle #2 was driven from the scene by Driver #2’s husband.
I later spoke with the occupants of Vehicle #1 who claimed the driver was not utilizing a cell phone and she did indeed come to a complete stop prior to entering the intersection. Driver #2 did not report seeing Driver #1 on a cell phone.
Driver #1 was issued summons #0614-VC-010732 for 39:4-144 (Stop Street) and subpoenas were completed for Driver #2 and witness.
Note: The Fire Department arrived on scene shortly after I arrived and Vineland Electric Utility also responded and repaired the utility pole. A request for electronic evidence preservation was completed for my body worn camera.

On 08/15/2016 I was dispatched to the area of Third Street and West Chestnut Avenue in regards to a two vehicle collision with no reported injuries. Upon my arrival I spoke with Driver #2 who stated he was travelling north on Third Street towards Chestnut Avenue. Driver #2 said while travelling, Vehicle #1 was stopped in the middle of the roadway and he attempted to stop. Driver #2 advised he could not stop the vehicle in time, and struck Vehicle #1 in the rear. Driver #2 and the passengers inside Vehicle #1 did not have complaints of pain. Note: Due to the passengers being juveniles inside Vehicle #2, EMS was requested to respond to the scene. After speaking to Driver #2, I spoke to Driver #1 who said the following: Driver #1 explained she was stopped on Third Street and was attempting to make a left turn into the park (Normandie Lane). Driver #1 said she could not turn into the park because of oncoming traffic, and she was struck in the rear by Vehicle #2. Driver #1 had a complaint of pain, but declined medical attention at the scene. Vehicle #1 sustained damage to the rear bumper portion, and Vehicle #2 sustained moderate damage to the front bumper portion. Vehicle #1 was driven from the scene by the owner, and Vehicle #2 was left at the scene. Driver #2 was issued the following summonses: Summons #0614-V-119260 for Carless Driving (39:3-97) Summons #0614-VC-8620 for Driving without Driver’s License in possession (39:3-29)
