On March 12, 2016, Sergeant Triantos and I responded to 2196 W Landis Ave, Bennigans, for a hit and run collision in the parking lot. Prior to my arrival Sgt. Triantos was flagged down by a concerned citizen who stated a vehicle on the west side of the lot backed into another vehicle and then pulled into a different parking stall. While Sgt. Triantos was speaking with the concerned citizen, he observed a tall black male, enter a pink Crown Victorian vehicle and drive away from the area where the vehicle was hit. Upon my arrival, I investigated the scene and observed pink paint chips and pink paint transfers on the rear bumper of a black 2006 Audi A4 bearing NJ registration H78FLF. I was then able to make contact with the driver of the Audi, Marcus Mattioli 3rd, who was working inside Bennigans at the time. Marcus stated he parked his vehicle around 5pm on the west side of the parking lot and came into work. Prior to completing this report, Sgt. Triantos observed the same pink Crown Victorian vehicle, at the Days Inn, and made a motor vehicle stop on it. Upon my arrival to the traffic stop, I observed a cracked rear passenger bumper along with black paint transfers and chipped pink paint from the vehicle. Sgt. Triantos also confirmed the same driver from Bennigans. The owner of the pink Crown Victorian, Octavian Graham made the following statements regarding the incident. Octavian stated he was at Bennigans and parked on the west side of the lot and entered the restaurant. After exiting the restaurant Octavian stated he entered his vehicle and pulled out of his parking stall, and left the premises. Octavian would not give me a clear answer as to if he backed out of his parking stall or drove forward out of his stall. Octavian was adamant about not striking a vehicle in the parking lot. After conducting my investigation, Octavian was issued summons 0614-VC-009858, 39:4-129 leaving the scene of an accident. Both vehicles had minor damage to the rear passenger bumper. I was unable to obtain video surveillance from Bennigans at this time.
