Q: Why does the City care about me parking in my yard?
A: To promote the conservation of public and private property values and improve the general health and safety of the community at large.
 
Q: What does the ordinance prohibit?
A: The ordinance prohibits parking cars, trucks, SUVs, vans, RVs, motorcycles, boats trailers, and other street legal vehicles from parking on unpaved surfaces in the front yard.
 
Q: Does it also apply to commercial property?
A: Yes, parking at businesses also has to be on a properly permitted and paved parking surface.
 
Q: If my guests don’t have on street parking, can they park on my front yard?
A: No, parking is only allowed on properly permitted driveways and each vehicle is a separate violation.
 
Q: What if I’m loading/unloading my vehicle?
A: There are limited exceptions for emergency vehicles and person ACTIVELY ENGAGED in loading, unloading, or washing their vehicle.
 
Q: What if the front yard is the only place I can park?
A: You may park on the street where allowed. The property owner may also apply for a variance from the Zoning Board of Adjustment, pay a fee, and submit evidence of the hardship to the Board in a public hearing. The Board decides if and under what conditions a variance will be issued to allow parking in the front yard.
 
Q: How is a driveway defined?
A: A properly permitted area constructed for the purpose of accessing a parking space, and surfaced with concrete or asphalt; or surfaced with brick, concrete, or stone pavers. A driveway must be properly permitted.
 
Q: Could I be fined if someone else parks on my yard without my permission?
A: The fine goes to the vehicle owner. If the vehicle owner is not known, the fine goes to the property owner. Ask violator(s) to move or call the Police at 328-9311.
 


Q: What is the fine? If I don’t move, will the vehicle be towed?
A: Each violation is a separate offense and each ticket is $50. Additional fees may be imposed by the court. Your vehicle can be towed from any public right of way. Typically, it will not be towed from private property under this ordinance.
 
Q: What if I don’t pay?
A: You may protest violations in court, but failure to pay may result in a summons to appear in court, followed by a warrant being issued and additional fines and/or jail.
 
Q: Can I park in the back yard?
A: Yes, this ordinance applies to front yard parking.
 
 
Section 11-8-9
Prohibited Parking in Front Yard
 
Prohibition. It shall be unlawful within the corporate limits of the City of Birmingham to:
 
Park or place, within a residential area a motor vehicle, recreational vehicle, boat, trailer, or other type of similar wheeled conveyance, in the front yard of a residence unless it is parked on a paved and properly permitted driveway that provides access to a carport or garage that is incorporated into the main house structure; or that provides access to a parking area located entirely within the side yard or rear yard.
 
Park or place, within a commercial area, a motor vehicle, recreational vehicle, boat, trailer, or other type of similar wheeled conveyance, in the front yard of a business unless it is parked upon a properly paved and permitted parking lot or paved driveway that provides access to the same.
 
Park a motor vehicle, recreational vehicle, boat, trailer, or other type of similar wheeled conveyance over and part of a curb, sidewalk, or unpaved portion of the right-of-way.
